1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you" or "User") and Azhar Ellahi, operating as MyAuctionVerse ("we", "us", or "our"), concerning your access to and use of the website at www.myauctionverse.com and all related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. Eligibility

You must be at least 13 years of age to create an account and use the Service. If you are between 13 and 18 years of age, you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service, you represent that you meet these age requirements.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. User Registration

You may be required to register to use certain features of the Service. You agree to:

  • Provide accurate and complete registration information.
  • Keep your password confidential and secure.
  • Be responsible for all activity that occurs under your account.
  • Notify us immediately of any unauthorized use of your account.

We reserve the right to remove, reclaim, or change a username if we determine, in our sole discretion, that it is inappropriate, misleading, or infringes on another's rights.

4. Purchases and Payment

We accept payment via Razorpay (Credit/Debit Cards, UPI, Net Banking). You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.

Refund Policy: All purchases for digital plan access are non-refundable once the plan has been activated. We encourage you to use the Free Trial to evaluate the Service before purchasing a paid plan. Refund requests for defective service may be considered on a case-by-case basis in compliance with the Indian Consumer Protection Act, 2019.

Prices are subject to change. We will notify existing subscribers of price changes at least 30 days in advance. Continued use after the price change takes effect constitutes acceptance of the new pricing.

5. Prohibited Activities

You may not access or use the Service for any purpose other than that for which we make the Service available. Prohibited activities include, but are not limited to:

  • Systematically retrieving data to create a competing product or database.
  • Circumventing security features or attempting to access restricted areas of the Service.
  • Using the Service to harass, abuse, threaten, or harm another person.
  • Using the Service for any unlawful purpose or to facilitate illegal activities.
  • Using the Service for real-money gambling or wagering of any kind. MyAuctionVerse is a fantasy auction platform only.
  • Uploading, sharing, or distributing any content that is obscene, pornographic, sexually explicit, offensive, hateful, defamatory, or otherwise inappropriate (including but not limited to NSFW images, player photos, team logos, or auction backgrounds).
  • Uploading malware, viruses, or any code designed to disrupt or damage the Service.
  • Impersonating another person or entity, or falsely stating or misrepresenting your affiliation.
  • Using bots, scrapers, or automated tools to access or interact with the Service without our written consent.

6. Auction Owner Responsibilities

MyAuctionVerse is a platform that provides auction hosting tools. Auction owners ("Auctioneers") are solely responsible for the organization, conduct, and content of their auctions. By creating an auction on the Service, you accept full responsibility for the following:

6.1 Participant Eligibility & Age Verification

Auction owners are responsible for ensuring that all participants they invite to their auction meet applicable age requirements. If an auction owner shares bid links or auction access with minors (under 18), the auction owner assumes full responsibility for obtaining appropriate parental or guardian consent and supervising the minor's participation. MyAuctionVerse does not verify the age or identity of participants invited via bid links.

6.2 Content Moderation

Auction owners are solely responsible for all content in their auctions, including but not limited to player names, player images, team names, team logos, auction backgrounds, and any content added by participants through player submission forms. As an auction owner, you agree to:

  • Review and moderate all player entries, images, and team logos before starting the auction.
  • Ensure that no inappropriate, offensive, defamatory, or NSFW content is present in your auction.
  • Ensure you have the right to use any images or content you upload, or that such use falls under fair use.
  • Remove any content that violates these Terms immediately upon becoming aware of it.

6.3 Compliance with Local Laws

Auction owners are responsible for ensuring their use of the Service complies with all applicable laws and regulations in their jurisdiction, including but not limited to data protection, consumer protection, and gambling laws. If an auction owner operates in a jurisdiction with specific requirements (e.g., GDPR in the EU), the auction owner is responsible for meeting those obligations with respect to participants in their auction.

6.4 No Real-Money Activity

Auction owners must not use the Service for real-money gambling, wagering, or any form of financial transaction between participants. MyAuctionVerse is a fantasy auction platform that uses virtual points or fictional budgets only. If an auction owner facilitates real-money activity through an auction created on the Service, they do so entirely at their own risk and liability.

6.5 Platform's Role

MyAuctionVerse provides the technology platform only. We do not pre-screen, actively monitor, or endorse user-uploaded content or participant conduct. We reserve the right to remove any content and suspend or terminate accounts that violate these Terms without prior notice, but we are under no obligation to do so. Reporting violations to us does not create liability on our part for any failure to act.

7. Copyright and DMCA Takedown

We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright, please send a written notice to our contact email with the following information:

  • A description of the copyrighted work you claim has been infringed.
  • The URL or location of the infringing content on the Service.
  • Your contact information (name, email address, phone number).
  • A statement that you have a good-faith belief that the use of the content is not authorized by the copyright owner.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Upon receiving a valid takedown notice, we will remove or disable access to the infringing content within a reasonable timeframe and notify the user who uploaded it.

8. Intellectual Property

Unless otherwise indicated, the Service, its design, source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content") are our proprietary property and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our express written permission.

9. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted, timely, or error-free access. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.

We are not liable for any loss, damage, or inconvenience caused by the inability to access the Service during downtime, including during a live auction event.

10. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

You may delete your account at any time through your account settings or by contacting us. Upon account deletion:

  • Your personal data will be deleted within 30 days, subject to legal retention requirements.
  • Your auction data (player lists, teams, results) will be permanently deleted.
  • Payment records will be retained for 7 years as required by Indian tax regulations.
  • Active paid plan subscriptions are not refundable upon voluntary account deletion.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your specific requirements.
  • The Service will be uninterrupted, secure, or error-free.
  • The results obtained from the Service will be accurate or reliable.
  • Any errors in the Service will be corrected within a specific timeframe.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYAUCTIONVERSE, ITS OWNER, OR ITS SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, revenue, profits, or business opportunities.
  • Interruption of auction events due to service downtime or technical issues.
  • Unauthorized access to or alteration of your transmissions or data.
  • Any conduct or content of any third party on the Service.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR INR 5,000, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless MyAuctionVerse and its owner from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service.
  • Your violation of these Terms.
  • Content you upload, including player images, team logos, or any other material that infringes on a third party's intellectual property or other rights.
  • Your violation of any applicable law or regulation.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

15. Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Service, the parties agree to first attempt to resolve the matter informally by contacting us at the email address below. We will make good-faith efforts to resolve the dispute within 30 days.

If the dispute cannot be resolved informally, either party may pursue resolution through binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Hyderabad, India. The arbitration shall be conducted in English.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last Updated" date. For significant changes, we may also send you an email notification. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
